Lay-Buy Financial Solutions Pty Ltd trading as www.lay-buys.com has identified core principles we believe are integral and imperative for all Lay-Buy agreement deals transacted through our PUT IT ON LAY-BUY checkout payment option to be fair and reasonable per the Fair Trading Act 1999.

The following principles below therefore make up the Terms & Conditions for any Lay-Buy or Layby contract and related transactions entered into. This applies to all and any Lay-Buy or lay-by contract utilized by both Pack Turtle and consumer:

  1. Record of Payment
    A record of payment transaction history will always be available for both Pack Turtle and the buyer, recording all amounts paid to date and the date and value of all future pending payments as per your agreed Lay-Buy policy.
  2. Storage and Identification of Lay-Buy Products
    Products on Lay-Buy will be set aside and stored separately from other products. Products will be clearly identified as ‘Lay-Buy contract’ products by a number or some other identification.
  3. Down Payment
    The buyer can select a down payment of 25% - 50% of the purchase as a first payment under the terms of all Lay-Buy deals.
  4. Cancellation of Lay-Buy by Buyer
    The buyer may cancel their Lay-Buy agreement form at any time prior to the shipment of products by advising Pack Turtle by email or phone. There is a restock fee of 15% that will be deducted from the refund. 
  5. Cancellation of Lay-Buy by Pack Turtle
    Pack Turtle under a Lay-Buy must not cancel it unless –
    a) The buyer breaches a term of the Lay-Buy; or
    b) Pack Turtle stops trading; or
    c) The products are no longer available
  6. Cancellation on breach by Buyer
    If a buyer has breached a term of a Lay-Buy and Pack Turtle intends to cancel the Lay-Buy, before doing so Pack Turtle must –
    a) Give the buyer notice of Pack Turtle's intention to cancel the Lay-Buy; and
    b) Allow the buyer at least 14 days within which to rectify the breach; and
    c) The notice to be given has to be: I) in writing, sent to the buyer’s last known email address, or, if the buyer so agrees, orally; and
    II) must specify the breach of the Lay-Buy for which the Lay-Buy is being canceled; and
    III) must state the time within which the buyer must rectify the breach;
    IV) must state the matters listed below:
    * The purchase price of the products;
    * Any restock fee kept under the agreement; and
    * The total amount paid under the Lay-Buy;
    * Any amount owing to either the buyer or Pack Turtle under the terms of the Lay-Buy on the cancellation of the Lay-Buy. The Lay-Buy is canceled at the end of the period specified in the notice unless the buyer rectifies the breach before then or Pack Turtle agrees not to cancel it.
  7. Cancellation where business closes
    If Pack Turtle under a Lay-Buy agreement proposes to stop trading before the agreement is completed, Pack Turtle must give notice of the proposal to the buyer and must either –
    (a) allow the buyer 7 days within which to complete the agreement.
    (b) cancel the Lay-Buy and refund the purchase in full.
  8. Cancellation where products are not available
    If the products are no longer available, Pack Turtle must cancel the Lay-Buy and refund all monies to the buyer in full.
  9. Effect of Cancellation by Buyer
    When a Lay-Buy is canceled by the buyer, Pack Turtle must refund all money paid within 7 days less the 15% restock fee.
  10. Service Fees
    Pack Turtle shall not charge the customer any interest charges, membership fees, or service fees on any Lay-Buy sales transaction. Lay-Buy Financial Solutions Pty Ltd trading as https://www.lay-buys.com charges a once-off admin fee, with the amount displayed to customers at checkout. The buyer will pay this amount to Lay-Buys at checkout at the time of paying the down payment. This fee is an admin fee and is therefore not refundable.
  11. Lay-Buy Reporting
    Pack Turtle shall have reporting in place for all Lay-Buy deals covering Down Payment made, Lay-Buy period, Frequency of payments required, Payment amount required per installment; and a full record of all payments made to date (amount and date on which made).
  12. Delivery
    The seller will only fulfill the order and deliver the product(s) after receiving the final installment payment for all Lay-Buy orders.
  13. MISCELLANEOUS
    14.1   This Agreement shall be binding upon, inure to the benefit of, and be enforceable by the representatives, successors, and assigns of the parties hereto.
    14.2   This Agreement may be amended only by a written instrument duly executed by all parties hereto.
    14.3   The parties hereby represent and warrant that each of them has full legal right, power and authority to enter into this Agreement and to carry out its obligations hereunder.
    14.4   This Agreement may be executed simultaneously in one or more counterparts, each of which shall be deemed an original but all of which together shall constitute one and the same instrument.
    14.5   Article headings contained herein are for reference purposes only and shall not in any way affect the meaning or interpretation of this Agreement.

Pack Turtle Pre-Orders!

Pack Turtle offers easy pre-orders so you can reserve the newest releases before they come out or get back-ordered and custom-ordered items.This is how it works:

  1. Pre-order products will be labeled as pre-orders and will have a pre-order option on the product page.
  2. Most pre-orders are listed with shelf-condition packaging. This is because it is possible that we may receive items that have minor damage to the packaging during shipment. Pre-orders listed in shelf condition are guaranteed to arrive with their packaging in shelf condition or better, and the mint-condition pre-order items we receive will be shipped on a first-come, first-served basis. 
  3. The estimated time of arrival/ship date will be shown as well in the product details. Arrival dates are estimates and are not guaranteed. 
  4. Order the item as normal. We require full payment for all pre-orders.
  5. Currently, the following payment methods are not available for Pre-Orders: Affirm, Lay-Buy, and Meta Pay.
  6. Once the item arrives from the manufacturer, we will automatically ship the item and send you the tracking information.
  7. The arrival dates are subject to change due to possible manufacturer delays. If your arrival date gets pushed back, we will email you. Note: Some items may not have an estimated arrival date and could show "TBA" (To Be Announced). Once we get an estimated arrival date from the manufacturer, we will update it on our site and notify you.
  8. If you need to cancel, no problem! Just send us an email or give us a call any time before your item ships and we will refund you in full if your item is not a High-Dollar Special Order or a Custom Order Item. Special Order and Custom order items are subject to a 25% restock fee if you cancel or return them, the exception being if there is a problem with the item. These Items will have the restock fee noted in the product description.
  9. In-stock items that are ordered along with pre-orders will ship with the pre-order when it comes out. If your order includes multiple pre-orders, the whole order will be shipped when the last pre-order comes in. Shipping costs are based on the weight of all of the items in your order, so they will all need to be shipped together. If you would like your in-stock items or specific pre-orders shipped without waiting for your later pre-orders to come in, please order your pre-order items separately. The exception is if the total of your in-stock items is enough for free shipping or if your individual pre-order items total enough for free shipping. We will then automatically ship out your in-stock items or your pre-order items as they come in. 
  10. Note about shipping costs: We estimate the shipping cost for pre-orders since we do not have the weight and dimensions until we receive the item from the manufacturer. If we are able to ship for less than you paid, we will send a partial refund for the difference after we ship your pre-order.
  11. Coupons and sales generally do not apply to pre-orders, but we may offer discounts or coupons specifically for pre-orders from time to time.

Cancellation Policy
Some items in our store may be offered to you as a pre-order or as a lay-away. This cancellation policy lays out how you can change or cancel these kinds of purchases. 

Lay-away

Purchasing with a lay-away option allows you to schedule monthly payments and the order is shipped once the balance is paid in full. These orders can be cancelled as normal, but there is a 15 % restock fee. Pre-orders
When you purchase a pre-order, you are buying an out-of-stock or soon-to-be-available product not yet in inventory. We may collect a full payment, no payment, or a partial deposit at checkout, store your payment method, and then fulfill and charge the full or remaining payment when the pre-order is ready to ship. 
You can cancel a pre-order order that has not yet been fulfilled. If the order has been shipped, then you can't cancel the order, but you can request a return under our refund policy by logging into your account HERE. See our refund policy for more details on returns and refunds. Click HERE to see our Pre-Order terms and information.

We hope you are always satisfied with products purchased at packturtle.com and we are committed to your happiness! We understand if something may not be right with an order and we are always here to make it right. If you need to return an item to us, you have 30 days from receipt of your order to ship the item back for a refund or replacement (subject to product availability). 

To be eligible for a return, your item must be in the same condition that you received it, complete, unworn, or unused, with tags, and in its original sealed packaging (if applicable). 

To start a return, you can go to your account HERE or contact us at help@packturtle.com. There is also an account login at the top of the page next to the search bar. In your orders, you have the option to return items. There is also a note section where you can put in details or request an exchange for something else. If you email us, let us know your order number and the item you would like to return or exchange. We’ll send you instructions on how to return your item. If there is nothing wrong with your item and you just change your mind, you will be responsible for the return shipping cost and we can simply deduct it from your refund.

We will email you a return label that you can print. If you plan to provide the return shipping label yourself, please send it by trackable carriers and email the tracking number to us. Items sent back to us without first submitting a return through your account HERE or contacting us will not be accepted.

Damages and issues 

We inspect all shipments for accuracy and all items for damage prior to shipment. Please inspect your order upon reception and contact us or start a return in your account HERE if the item is defective, damaged, or if you receive the wrong item or the item is misrepresented in the ad in some way.


Exceptions / non-returnable items
Unfortunately, we cannot accept returns on worn clothing, products that have had the packaging opened, donations or gift cards. Some of our pre-order items are considered special orders and may have a cancellation or restock fee associated with them. This will be clearly shown in the product description.

Exchanges
Will would be happy to make an exchange for you instead of a refund if the item is in stock.

Refunds
We will notify you once we’ve received and inspected your return. Once approved, you’ll be automatically refunded on your original payment method. Refunds will include the original purchase price and tax minus the cost of your return shipping label. Return shipping costs are covered by Pack Turtle in the event there are damages or other issues as described in the "Damages and issues" section above. Please remember it can take some time for your bank or credit card company to process and post the refund.

Shipping FAQs

1. Do you offer international shipping?

Yes! Some items are limited. Click HERE to see products that can only ship to the USA and HERE for USA and Canada only items. We ship to most countries. If your location is not listed, reach out to us by email. Once we verify that we are able to ship to your country without restrictions, we will add your country to our website and let you know by email when you can place your order. Shipping costs will include insurance for items requiring extra insurance coverage. Applicable, duties and taxes will be pre-paid with some services, but some services require duties and taxes be paid by the receiver upon delivery. Your responsibilities to pay duties and taxes are noted under your shipping options at the checkout screen (see the example picture below). Please note: there are no free shipping options for international orders at this time.

We verify all international orders, so watch for an email from us. We will verify what items you ordered and the shipping address. We do this to avoid problems and delays with your delivery. Make sure to check your SPAM and Promotions folders if you are using those in your email.

2. How much does shipping cost? 

Costs will vary depending on the speed of service you choose and the weight of the package. There is a shipping estimator on the shopping cart page that will give all of the shipping costs available for your order and the estimated delivery time.

3. How long does shipping take?

Shipping times depend on the service you choose. USPS Priority Mail, for example may take 2-4 days depending on your location, but it is more costly than a standard shipping option, like Ground Advantage. The shipping calculator on the shopping cart page will give an estimate of the shipping time. Shipping times are estimates and are not guaranteed. If you would like overnight shipping or other guaranteed shipping service not seen in the shipping options offered at checkout, feel free to contact us for a shipping quote.

4. How long is your handling time?

Orders are generally shipped the same day or the next business day, but could take up to two business days. Handling time is included in your shipping delivery time estimate on the shopping cart page, so in most cases, you will receive your order before the estimated delivery date. 

** We rush orders during the holiday season, so the holidays may have faster handling times. Watch for updates at the top of the page during busy holiday times. **

5. Do you offer same day shipping?

We try our best to get orders that are placed before 11AM EST shipped the same day. For Saturdays, it is 9AM. At this time, we cannot guarantee same day shipping, however you can always contact us to request that we ship your order that day.

6. Can I change the shipping address after placing my order?

As long as the order has not shipped out, we can always change the shipping address. Be advised, there may be additional shipping cost or a partial refund if the shipping address is changed after your order has been placed. 

7. Do you ship on Saturday?

Yes, we do! There is one exception. We cannot ship Expedited services like 2nd Day or Next Day Air UPS shipments on Saturday.

8. How does local delivery work?

NOTE - Local delivery scheduling online only works through our desktop website. You can alternatively call or email us to schedule your delivery after placing your order through phone or tablet:

We deliver Monday - Saturday, 9AM - 4PM.

There is a $3 flat fee for local delivery, limited to a six mile radius of zip code 23325. If you order by 2 PM you can schedule to receive your delivery the same day if time slots are available. On your cart page, choose the Local Delivery option and choose a time slot to schedule the delivery. After you complete your order, you will receive updates on your delivery. We are providing no-contact delivery and will ring your doorbell and leave the package at your door and wait in our vehicle until you retrieve it. Please note, we cannot leave a package with no one to retrieve it. If you miss the delivery, we will contact you to reschedule. If you are not sure if you are within the delivery area, simply choose the local delivery option and your desired time slot. Once you put in your address and get to the checkout page, you will see the local delivery option among the other shipping options if you are close enough.

9. Do you offer local pick-up?

Do to accessibility restrictions, we do not currently offer order pick-up, but we are working to move to open a location where customers will be able to pick up their orders. 

Other info:

- We reuse and recycle shipping boxes whenever possible, so you may not always get a brand new box with the Pack Turtle stamp on it.

- Our packing peanuts are made from corn starch and are 100% biodegradable and environmentally safe.

- All of our other packing materials are recyclable.
